A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The situation originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling charges, he was held in immigration detention.

In her order, the court pointed out that the authorities lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "for now."
